4541 C - PERSONNEL - ABSENCES AND LEAVES - ILLNESS

Sick leave is accrued one (1) day per each work month. Unused sick leave may be accumulated up to 120 days.

Sick leave cannot be considered as entitlement or as annual leave.

The Board of Education or Superintendent may request evidence of need for sick leave in any instance. In the event an employee misuses or purports to misuse the benefits under this policy, he or she will forfeit benefits that are due or may accrue to him/her under the terms of this agreement.

Any unused portion of accumulated sick leave of any employee who dies while in the employment of the Grand County School District will accrue to the benefit of the surviving spouse or the estate of said employee, at the rate of pay per day on the date of death.

Leave shall be granted personnel under the following conditions:

1. If absence is more than three (3) consecutive days for any one illness of an employee, or a person of significant relationship to the employee including but not limited to spouse, former spouse, father, mother, grandfather, grandmother, grandchild, sister, or brother in the family of either the husband or wife, or anyone who has virtually held the position of parent, spouse, child or intimate associate, a physician's statement of cause and duration may be requested by the Board of Education before granting salary.

2. Any illness or injury of long duration or of unusual frequency shall be evaluated by the Board of Education. Determination of allowances to be made to the person involved will be based upon a physician's statement evaluating the illness or injury and including a statement of causes and confirmation of duration or frequency. 

In the event an illness or injury disables a person to the extent he or she cannot perform his or her duties, full payment of his or her regular salary will be paid up to but not exceeding the employee's sick leave available. The employee must meet the terms of the above paragraph continue under the care of a physician and provide progress reports from said physician as requested by the Board.  

3. All leave privileges may be discontinued by the Board of Education for any employee for misuse or misrepresentation.

Sick Leave Incentive

Upon retirement an employee shall be paid in a lump sum 25% of their current hourly rate of pay times the number of personally accrued unused sick leave hours. Of the remaining balance of hours up to fifty percent (50%) can be donated to increase the Sick Leave Bank balance if requested by the departing employee.

Employees applying for leave with pay for restoration of health must comply with the following regulations:

1. upon application for leave for restoration of health the employee shall present a written statement by a medical doctor to the effect that such leave is necessary for health purposes, stating the length of time such leave of absence is necessary;

2. a written statement must be presented from the medical doctor at the end of each three months period during the leave of absence, to the effect that the leave should continue in force for the best interest of the employee concerned;

3. at the conclusion of the leave of absence, a statement must be submitted from a medical doctor showing that the health of the employee concerned is such that he/she is able to return as a full time employee;

4. in the event an employee of the District is diagnosed with AIDS (Acquired Immune Deficiency Syndrome), said employee will be placed on sick leave until such time as a committee can review the medical/job placement status of the employee, the most recent research findings and the danger of transmission. The committee will be made up of the employee's physician, a representative of the Board of Health, a physician appointed by the District, the employee's principal/supervisor, and a representative of the District administration. In the event that a return to position placement is precluded, the employee will be encouraged to apply for benefits available under the District's long term disability policy.

Part-time hourly employees will be granted medical leave in accordance with District policy and may request the team evaluation process in order to protect their position and rights to continued employment.

4543 C - PERSONNEL - ABSENCES & LEAVES - DEATH AND FUNERAL

All Full-Time Classified Employees

Employees may be absent from their assignments without loss of pay for a maximum period of three (3) days in any one instance for death and burial involving spouse, mother, father, grandmother, grandfather, grandchild, sister or brother in the family of either the husband or wife, child or anyone who has virtually held the position of parent, spouse or child. Absences for other members of the family or close friends must have special approval of the building principal. When distances of over 400 miles is involved one extra day is allowed.

4544 C - PERSONNEL - ABSENCES & LEAVES - FAMILY LEAVE (ALL EMPLOYEES)

All classified employees for whom the District pays full medical benefits, regardless of annual hours worked, will be covered under the family leave guidelines.

The employee will inform the school administration upon confirmation of her pregnancy. At least three months prior to expected delivery, the employee will express her intent to complete the contract year or request a leave of absence.

If the employee determines to complete the contract year, the following conditions will apply:

1. disabilities caused or contributed to by pregnancy, childbirth or related conditions, for all job related purposes shall be treated the same as disabilities caused by other medical conditions under the District's health or disability insurance and sick leave;

2. fifteen (15) working days following delivery, the employee will return to her regular assignment or provide the principal or supervisor with a physicians statement explaining the medical conditions which prohibit the return to full-time duty; and

3. salary will not be paid when the leave is extended beyond the fifteen (15) day period and not supported by a physicians statement of medical need.

Employees may also have the option to request a leave of absence for one contract year or any part of a contract year up to one full semester with no change in placement on the salary schedule and with the assurance of an assigned position upon return to employment. No salary or benefits will be paid during this type of leave.

The Superintendent will consider other options if unusual or extenuating circumstances develop as a result of pregnancy or delivery.

This policy does not require the District to pay salary, insurance benefits, or provide leave considerations for abortions, except where the life of the mother would be endangered if the fetus were carried to term, or except where medical complications have arisen from abortion.

To be eligible for these federally protected rights, an individual must be employed by the School District for the previous twelve months and must have worked for at least 1,250 hours during that 12-month period.

As a matter of legal right, any eligible employee is entitled to a combined total of 12 weeks of unpaid leave per year for the following four leave situations:

1. the birth and first-year care of a child;

2. the adoption or foster placement of a child;

3. the illness of an employee's spouse, parent, or dependent child, and

4. the employee's own illness

When the District employs both spouses, the combined amount of leave for birth, adoption, and family illness may be limited to 12 weeks. However, personal illness would not be similarly limited in this situation.

4545 C - PERSONNEL - ABSENCES & LEAVES - PERSONNAL/PUBLIC SERVICE

At the employee's request, and for appropriate reasons including but not limited to the employee's health, the Board may grant a leave of absence with or without loss of pay so long as the employee is not deprived of any leave to which he or she is entitled by law.

Public Service Leave

The Board does encourage employees to be involved in public service activities that would be mutually beneficial to both the employee and the School District. The Board may grant public service leave, with partial pay, if such absences do not exceed a total of twenty (20) contract days per year, and if the employee who is granted such leave continues to plan and prepare for his or her district assignment. The Board will pay the difference between the compensation received for the public service position and the employee's daily contract salary. The employee will also receive insurance, retirement, and other fringe benefits provided to other employees in similar positions in the District.

Public service shall be defined as jury duty, election to part-time political office, National Guard or military reserve training assignments of short duration, participation in community, county, or other governmental advisory boards, association service, and other related activities.

If an employee is elected, appointed, or otherwise involved in a public service position which requires an extended absence (more than 20 days during the contract year) the Board may grant leave without pay for such extended absence. However, the Board will continue to maintain insurance benefits for the employee for the duration of the contract year during the approved leave of absence.

If called as a witness, in order to have the day of leave granted and receive the regular salary the employee will need to provide the District Office a copy of the subpoena and the check issued by the court. This same procedure should be followed in the case of jury duty.

Personal Leave

A maximum of two (2) days personal leave with pay may be granted to each staff member working in excess of twenty (20) hours a week under the following conditions:

1. Personal leave forms must be submitted to the supervisor, or his/her designee forty-eight (48) hours prior to the requested leave date. If, in emergency situations, leave cannot be arranged forty-eight (48) hours in advance, or scheduling problems occur, the supervisor or his/her designee may consider granting the leave on a case-by-case basis.

2. Employees who do not use all of their granted personal leave days may carryover no more than two (2) days for use in the following year. No more than two (2) days can be carried over and no more than four (4) days can be accumulated in any year. The employee must receive approval from the Superintendent if more than two (2) consecutive days are to be used in any one instance.

Personal leave is for personal use and the employee will not be required to give an explanation for the request except in the case of an emergency which does not allow for the required forty-eight (48) hours prior notice.

4546 C - PERSONNEL - SICK LEAVE BANK

The Sick Leave Bank is for continuing employees only provisional employees do not donate or receive.

Eligibility Requirements

The purpose of the Sick Leave Bank is for Grand County School District Classified Employees to share sick leave for long term illnesses. It is available to classified employees who are not provisional employees, and only employees who contribute to the Sick Leave Bank may withdraw from the bank.

Each year employees who wish to be eligible to draw from the Sick Leave Bank must have one sick day available on October 11th in order to contribute one (1) sick leave day to the bank.

When the bank has a balance greater than 400 days remaining at the end of the academic year, the Association and the District may agree to suspend the contribution requirement for one (1) year. Should the bank fall below 400 days, one (1) day per member per year will be assessed until the bank is again built up to 400 days. Any employee who did not previously participate in the bank, but desires to participate during the non-contributory year shall be required to donate one (1) day to initiate eligibility by submitting the appropriate form during the open enrollment period as designated by the District.

Limitations:

1. No employee will be allowed to draw from the Sick Leave Bank and another district program simultaneously.

2. Days used from the Sick Leave Bank will be granted only after all accrued sick leave, personal leave days, and vacation days have been used.

3. The Sick Leave Bank becomes available after ten consecutive days of absence.

4. An employee withdrawing from membership in the Sick Leave Bank program will not be able to withdraw any days that said employee has previously contributed.

Exemptions:

Under this policy elective surgery is not eligible for Sick Leave Bank days.

Procedure for Application

1. The employee may request use of Sick Leave Bank days from their supervisor/principal who will submit the request to the Business Administrator and GCEA President to determine eligibility.

2. Should all Sick Leave Bank days be used, classified employees will be notified and given the opportunity to add additional days.

Unused Sick Leave Bank days will be rolled over from year to year.

Abuse of the policy will result in suspension of the benefit.

Sick Leave Incentive

4547 C - PERSONNEL - ABSENCES & LEAVES - COMPASSIONATE

Circumstances not covered under any of the other leave categories necessitating the absence of the employee will be understood to be of emergency basis and all sick leave and personal leave days must be used before applying for this leave. The building principal may recommend a compassionate leave, and will seek approval from the Superintendent. Compensation will be the same as for sick leave.

If the Superintendent denies the leave, leave is denied by the Superintendent, the employee may request a hearing before the Board of Education.

Examples of compassionate leave include, but are not limited to:

1. accident involving his or her person or property, or involving a person of significant relationship to the employee including, but not limited to, spouse, former spouse, father, mother, grandfather, grandmother, grandchild, sister, or brother in the family of either the husband or wife, or anyone who has virtually held the position of parent, spouse, child or intimate associate;

2. appearance in court as a litigant; or a witness under official order;

3. attendance at grievous illness of someone other than those defined in #1 above.
