2410 - COMMUNITY - GIFTS 

GIFTS TO SCHOOL PERSONNEL

No District employee shall knowingly receive, accept, take, seek, or solicit, directly or indirectly, any gift, compensation or loan for the employee or another if:

1. It tends to influence the employee in the discharge of employment duties, or

2. The employee recently has been, or is now, or in the near future may be involved in any governmental action directly affecting the donor or lender, unless a disclosure of the gift, compensation or loan and other relevant information has been made in the manner provided below.

This section does not apply to the following: 1. An occasional non-pecuniary gift having a value of not in excess of $50.00;

2. An award publicly presented in recognition of public services;

3. Any bona fide loan made in the ordinary course of business by an institution authorized by the laws of this State or any other state to engage in making such loans.

4. A political campaign contribution if the contribution is actually used in a political campaign of the recipient District employee.

GIFTS TO STUDENTS 

The acceptance of trophies, prizes or awards from persons or organizations not connected with the schools is not approved unless they conform to the policy of the Board and the corresponding administrative regulations providing for awards for distinguished success in any school activity. (See Student Policy - Awards #5450).

2415 - COMMUNITY - GIFTS AND DONATIONS

The District welcomes gifts and donations. The District has organized a Foundation, the Grand Education Foundation, which has the purpose of receiving and administering gifts to support excellence in education, pursuant to Utah Code Ann. '53A-4-201 to -205.

IRS Tax Credit

Donors who desire to obtain a receipt for tax purposes should prepare and submit with the gift an Internal Revenue Service Form No. 8381. Donors must obtain advice from their own advisers as to whether gifts to the District are tax deductible. The District will sign and return a properly prepared form (8381) to give the donor a record that the gift was received by the District. The District will not otherwise certify as to the value of property that is donated in kind.

Approval of District

Part of the process of making a gift is obtaining the approval of the District for conditions that may be attached to the gift. Gifts of property given in kind must be reviewed prior to acceptance to make sure that the property will be useful to the District and that the property is in acceptable condition and not subject to liens and claims that would cause expense to the District. Gifts to specific school programs of equipment, such as computers and audio-visual equipment, must be approved in advance to assure that the District is not compelled by a gift to undertake expenses in support of the donated equipment or make other management decisions in order to use the gift, such as allocating space to donated equipment, that the District deems to be unwise.

As a general rule the District will not commit to name classrooms in a building or a building itself with the name of a donor as a quid prop quo for a gift. The action to name buildings or parts of buildings is within the power of the Board of Education, however, and in a particular case the Board may be resolution agree to name a facility for someone designated by a donor. The Board does not delegate this authority.

2420 - COMMUNITY - SOLICITING FUNDS FROM SCHOOL PERSONNEL

No fund raising drives by non-school agencies to solicit funds from school personnel are permitted within the schools.

Tickets to affairs sponsored by or for non-school agencies shall not be sold in any public school or on school premises by any school or school organization or by any non-school organizations, except at the box office at specified times.

2430 - COMMUNITY - CONTESTS FOR STUDENTS

Contests and activities which are sponsored by outside agencies and which involve participation by pupils or the granting of awards or prizes to pupils shall not be announced or permitted in the schools unless approved by the principal of the school involved. Such activities must be adjudged to have educational value for the participants before permission may be granted.

Criteria for Selection of Educationally Desirable Contests

The primary educational aim of the schools and the needs and interests of their students must be the first consideration at all times.

1. On a national basis, the schools should confine their participation to those national contests that are currently placed on the approved list published annually by the Committee on National Contests and Activities of the National Association of Secondary School Principals.

2. On a State and local basis, the contest or activity should be:

A. one that supplements and does not interfere with the regular school program.

B. one that is beneficial to youth in educational, civic, social or ethical development.

C. one that makes it possible for individual students to work out contributions by their own efforts and does not invite dishonest collaboration.

D. one whose subject is not commercial, controversial, sectarian or concerned with propaganda. It must emphasize high moral standards, good citizenship, and intellectual competence.

E. one from which no contestant should be excluded because of race, color, creed, or payment of entry fee.

F. one which does not place an undue burden on students, teachers, or the school, nor require frequent or lengthy absence of participants from school.

G. one sponsored by an organization engaged in a creditable or acceptable enterprise regardless of kind or amount of prizes offered and must not use the contest or activity as a "front" for advertising a company name or product.

The Superintendent will institute such rules and regulations as in his or her judgment are necessary to implement this policy.

2440 - COMMUNITY - PUBLIC PERFORMANCES BY STUDENTS

The Board recognizes that worthy and appropriate educational values accrue from student participation in civic and community affairs. Teachers will be encouraged to provide students for public performances when:

1. such performances fit both the aims of the schools and the needs of the students;

2. such performances are free from the kinds of appeals and pressures that limit the best development of participants;

3. no student is excluded because of race, color or creed;

4. such performance is appropriate to that age group.

Students may perform where admission fees are charged only if the proceeds are used for charitable, educational, or civic purposes. The school may accept payment for performances but individual students may not accept such payment Costs directly related to performances, the supervision of students, and liability protection for student participants will be the responsibility of the school district.

2450 - COMMUNITY - ADVERTISING & PROMOTION

The use of displays in our schools or distribution of pamphlets and literature relating to non-school subjects or activities by non-school organizations is looked upon with disfavor by the Board. The use of educational materials such as training films bearing only the name of the donor or producer on the lead or trailer, is left to the discretion of the principal of the school concerned.

Pupils, staff members, or the facilities of the school may not be used in any manner for advertising or promoting the interest of any community or non-school agency or organization without the approval of the Board.

The Superintendent may cooperate in furthering the work of any non-profit, community-wide social service agency provided such cooperation does not infringe on the school program or diminish the amount of time devoted to the school program.

The Superintendent may authorize the use of films and materials which simply bear the name of the producing company but which do not in any way involve a program or the presence of any agent or person in the classroom.
